Stan Mustaţă says he has been warned of the danger because of this case and accuses the prosecutors of manipulation in the case that he is being tried for corruption.
Mustaţă says that the whole process has not actually started with the allegations of corruption, but with the fact that he was judge in the most serious political file of the past 25 years.
"My defense is the Voiculescu case file, my arrest originated from it . Before Easter, after several drinks, Boraciu said, hurry up and settle Voiculescu’s case, otherwise you will be arrested, convicted and you will lose your pension. Which is exactly what happened to me. And he asked me who are you in reality that these people cannot hold anything against you? If I was not drinking, then maybe I would have realized the danger. In the Voiculescu case I gave short terms, therefore I did not attempt to delay it, " Stan Mustaţă said in the court.
Stan Mustaţă’s defense attorneys argued that the magistrate was pressured to rule as quickly as possible in the ICA file and the charges that he would have delayed the ruling are unfounded..
The head of DNA, Laura Codruţa Kovesi, acknowledged in a veiled way in an interview in August that Mustata’s arrest was related to the Telepathy case file.
"During the monitoring that has been done and the evidence showed it turned out that in a way, this Judge pre-empted at the time on the case trial, arguing in discussions with third parties that he wanted to postpone this case after December 2014," Codruţa Laura Kovesi, head of DNA said in August.
Mustaţă claims that the DNA prosecutors presented in a distorted way the conversations he had in a private environment, to make it look as if he attempted to influence the Telepathy case file track.
"(...) There is a line by Boraciu, in page 23, < to take it further to December and beyond>, that is the only clue of the DNA. No money was asked for, there was no interaction with those people, no solutions promised, nor rigged rulings pronounced " Stan Moustache said.
Judge Stan Mustaţă was arrested even before entering the courtroom in the Telepathy case. He would have had to decide whether or not to accept the requests filed by the lawyer Gheorghe Mateut. Subsequently, the new panel of judges dismissed all claims forwarded by the defense.
Mustaţă is the second person who makes this accusation in this case. In the previous term , a witness made the same allegations against the prosecutors.
Radu Tudor: It's a file reopened for political reasons. Judge, collateral victim
Radu Tudor argues that, in this case, it is an imposed solution by the DNA, and Judge Stan Mustaţă is collateral victim.
"It is clear to me that we are dealing with a solution imposed by the DNA. This judge is collateral victim that DNA and some institutions have done in Telepathy case. (...) It is a file reopened for political reasons" , journalist Radu Tudor said Monday in a telephone intervention on Antena 3.
