Razvan Dumitrescu presented in the Tuesday evening edition of the show "Subjective" the composition of the Constitutional Court of Romania as  the decision to validate or invalidate the referendum is currently in the hands of the Court judges.

Four of the Court judges were appointed by Traian Basescu and the Democrat Liberl Party (DLP). Here is the full list with the names of the CCR judges.

- Augustin Zegrean, appointed by president
Basescu in 2007

- Peter Lazaroiu, appointed by president
Basescu in 2010

- Mircea Stefan Minea, appointed by the Chamber of Deputies (DLP) in 2010

- Iulia Motoc, appointed by the Senate (
DLP) in 2010

- Caspar Acsinte, appointed by ex-president Ion Iliescu in 2004

- Aspazia Cojocaru, appointed by the Chamber of Deputies (Social Democrat Party - SDP) in 2004

- Ion Predescu, appointed by the Senate (SDP) in 2004

- Tudorel Toader, appointed by the Chamber of Deputies (NLP) in 2007

- Zoltan Puskas called the Senate (UDMR) in 2007

According to Oana Stănciulescu, a decision on the referendum must be made by 6 to 3 votes. She also mentioned that she did not think that the CC would decide in favor of those who had initiated the project, or most probably they would decide the same as in the impeachment case, sending it to Parliament to be solved.
