The lawyers will use the extraordinary  means for appeal to challenge the Supreme Court’s decision, which rejected the appeal for cassation filed by Dan Voiculescu in the Telepathy case file. Lawyer Gheorghiţă Mateuţ announced he will call for  revision,  an approach which enables the resolution of some judiciary errors.

Moreover, Dan Voiculescu’s  defender said he already filed a complaint with the ECHR, on  the following issues: violation of the right to a fair trial, independence and impartiality of the court, the presumption of innocence - through public statements made by Traian Basescu - and the right to information and defense.

Defenders have also showed that judges Camelia Bogdan  and Alexandru Mihalcea from the Court of Appeal willfully ignored the evidence obtained by the  DNA that demonstrated the innocence of the defendants in the Telepathy case.

Judges Camelia Bogdan and Alexandru Mihalcea rejected 50 applications for evidence without any reasons. Among  them the hearing of the former Minister of Agriculture, Dacian Ciolos, and President ‘s Traian Basescu. The counselors  argued that the expertise rejected by the magistrates would have blown to pieces the  DNA charges.

The huge  documentation containing  40 volumes provided on request by the anticorruption prosecutors reveals that the 40 privatizations made by ADS in 2002-2007 – including the  privatization the of ICA - were made in the same manner, using the simplified procedure. Although  for all the  other 39 identical privatizations made by ADS, the  DNA prosecutors gave solutions not  to prosecute,  only in  the " Telepathy file " , prosecutors Emilian Eva and Doru Ţuluş identified a crime therein.
