The judge for rights and freedoms shows in the court’s reasoning to reopen the case file known by the name “stinky gypsy”, that in the said case, no criminal prosecution action was performed and no evidence showed , being a “particular situation”, Mediafax reports.

The magistrate of district 1 court invokes the fact that president Traian Băsescu enjoyed his immunity, for which reason, the criminal investigation could not be set off nor against the offence nor against the person meaning the former head of state.

District 1 court confirmed the reopening of the prosecution for theft, robbery and insult related to the facts allegedly committed by the former head of state, who, in 2007, used the appellation "stinky gypsy" against a journalist and took away her mobile phone.


On May 23, 2007, the National Council for Combating Discrimination (CNCD) decided to sanction President Traian Basescu with a warning, after they ruled in unanimity that the use of the expression "stinky gypsy" by former head of state against journalist Andreea Pană from Antena 1 was an act of discrimination.

The former president then challenged the CNCD decision before the the Court of Appeal (CAB), but in November 2007 the court rejected the complaint as unfounded. Subsequently, Traian Basescu appealed the decision before the supreme court.

The High Court of Cassation and Justice (HCCJ) admitted on 15 May 2008, Basescu's appeal, considering that the term the former head of state used in addressing a TV reporter was discriminatory.

In 2007, the former president snatched the mobile phone of journalist Andreea Pana, who was filming him while he was shopping in a hypermarket. He addressed the journalist with the nickname "pussy".



After the president got into his personal car, the phone registered Basescu while he called the journalist a "stinky gypsy". That recording was deleted. Subsequently, the device was returned, and the employees of the TV station managed to recover the recording of the affirmation by the head of state, which was made public.
