His statements are in response to the misinformation about the Telepatia case file, launched by Laura Codruţa Kovesi.
Kovesi pressures the judges to rule a sentence as quickly as possible in the Telepatia case file on the grounds that the criminal facts might be prescribed. All that despite the fact that Dan Voiculescu submitted since February 20 a request for continuance of the trial, whereby a possible negative prescription thereof would not be possible.
"It's not about any kind of prescription. Professor Mateuţ told me countless of times that the prescription Mrs. Kovesi is speaking about is nonsense. He told me that the prescription of the case file in question is dues for 2023, as such I do not know where this obsession for December 2014 comes from", Professor Dan Voiculescu said.
"There are two charges in the case file. The first charge was prescribed 2 years ago, but I submitted a request whereby I said I did not want to benefit from any prescription, but that I wanted a trial. I asked for the trial to be continued (.. .). The prescription for the second charge expires in 2018 or 2023. My question for everyone is: Mrs. Kovesi does not know the Penal Code? Or she may know things we do not know", Dan Voiculescu said.
"Prosecutor Kovesi allows herself from the high office she holds to break the law and I am referring to well-known law, the Law 303 of 2004, which prohibits the magistrates to publicly express their views on the case file before the court", he added.
President founder of the Conservative Party said that drafted a letter to be sent in " the attention of the ambassadors accredited to Bucharest, in the attention of Western governments, in the European Commission and the Council of Europe and the international organizations dealing with monitoring the activity of the justice."
"We need to clarify how a chief prosecutor can make so many mistakes in a row. Normally these things would result in an order that would make Mrs. Kovesi withdraw from the bench", Dan Voiculescu said.
According to him, the statements of Laura Codruţa Kovesi are based on Traian Băsescu’s desire for revenge.
"This irritation is based on someone's mad desire, and here I am referring to Basescu, the desire to see me in jail before leaving the Cotroceni. Folks, my files will not be prescribed because I do not want to. My case files will be tried in the court. I do not want a prescription nor now nor in 2023. I want to have a clear court judgment to indicate whether I am guilty or not, " Dan Voiculescu said.
