Update 18.57 –Dan Voiculescu’s appeal for annulment in the Telepathy case file has been rejected, this evening, as unfounded by the Court of Appeal and the PC founder attorneys have already submitted an appeal in cassation.
The judges’ decision is final and the sentence was taken by a divergence panel of three judges.
Dan Voiculescu's lawyer, Gheorghe Matei, tried to convince the three judges that those who gave the final decision in the Telepathy case were incompatible and were deliberately distributed to rule on this case.
Instead the judges from the Court of Appeal considered that the former decision was correct.
Currently, there are no more possibilities for appeal in this case, but there is an extraordinary remedy, namely the appeal in cassation. Lawyer Mateuţ says that he had already made a request to that effect to the High Court of Cassation and Justice (HCCJ).
Adrian Ursu: I do not believe that there is any strong justification for such a decision
Adrian Ursu, Antena 3 producer, said Tuesday, after hearing the decision given by the Court of Appeal that he did not believe that there was any strong justification for such a decision.
"We do not know exactly what were the reasons that led to this decision. This case file Telepathy has many angles from which it is viewed. Over time it received a not to prosecute decision, several favorable judgments of those who are now in prison, a lighter sentence than the current one (10 years in prison – editor’s note). (...), " Adrian Ursu said Tuesday in a telephone intervention on Antena 3.
"We'll see which is the justification of the decision, I do not think there is a strong justification, given the way the panel of judges was decided," Adrian Ursu added.
Cătălin Ivan, former PSD spokesman, invited on Antena 3, considered that this case file of a Dan Voiculescu is a "difficult one, with many question marks".
In his turn, lawyer Lucian Bolcaş, said that the court’s decision was "astounding".
