The prosecutor who handled the "Telepathy" case file, Emilian Eve, remains in custody, magistrates decided.

Emilian Eva became known after he investigated the privatization of the Food Research Institute case file in which Dan Voiculescu was sentenced to ten years in prison.

The indictment the prosecutors drafted states the following facts:

Throughout the months of May and June 2014, during which time a relative of his was hospitalized, defendant Eva Emilian asked a doctor to make all efforts "so it should all be well for everyone", meaning to grant special treatment to a hospitalized person.
Following this request, on 16 June 2014, the defendant Emilian Eva ordered through a deputy the dismissal of a criminal case or waiver of prosecution against the doctor concerned, who was under investigation for bribery, fraud, abusive behavior, forgery, use of forgery. The settlement was arranged at a four days interval after the relevant case file was handed in to prosecutor Eva Emilian.
After the favorable settlement in this case, between August 2014 - January 2015, defendant Emilian Eva requested and received from the doctor various goods and undue benefits in consideration for the favorable resolution given.
Thus, during that period, the physician has provided to the defendant Eva Emilian for purposes mentioned above, various goods in the form of artwork valued at the sum of 16,900 euros (consisting of a total of 13 paintings), money in the form of loans incurred in the amount of 3,900 euros and undue benefits (in the form of a fee of 13,000 euros charged by the defendant during a transaction executed by the denouncer witness), all amounting to 33,800 euros.

Between January and February 2015, benefiting from the help of his daughter, defendant Eva Bianca Madalina, the defendant obtained from the Ministry of Culture - Directorate for Culture Iasi, a permanent export certificate and sent to the United Kingdom a number of 3 paintings , to be sold through an auction houses located within the state mentioned above, one of the paintings being claimed and received as bribe. By proceeding in this manner, the defendant Eva Emilian concealed the illegal nature of the paintings received as bribe.


Between August 2014 - June 2015, the defendant Eva Emilian purchased for resale in order to obtain materials profits, brokered the sale or purchase of paintings, charging fees on transactions brokered for more than 200 paintings, although the capacity of magistrate is incompatible with carrying out business activities.

Specifically, between November 2014 - April 2015, the defendant Eva Emilian purchased from various individuals 94 paintings, some signed by well rated Romanian and foreign artists, which, directly or through intermediaries, he left them in custody for evaluation at an auction house in Bucharest.

During January-February 2015, the defendant Eva Emilian posted ad through intermediaries, for sale on a website of 34 paintings alleged to be signed or executed by famous painters.

Between August 2014 - June 2015, the defendant purchased or led negotiations for the purchase from various individuals or galleries, asked for evaluations from people with expertise, restored, using various painters / restaurant and capitalized or attempted to capitalize a number of about 97 paintings.

Analyzing the declaration of assets for 2015, given on oath, it appeared that the defendant Eva Emilian made untruthful statements in this letter which are in total contradiction to the facts described above.

In order to conduct the business operations described above, the defendant Eva Emilian has also involved the other two defendants, who during hearings conducted in this case made untrue statements about key facts and circumstances about which they were questioned in the sense that they did not acknowledged the help they provided the defendant with in the paintings transitioning.

The attachment of goods and properties was ordered in the case, namely over a building and 126 paintings belonging to defendant Eva Emilian.

Prosecutors have been granted special support from the Romanian Intelligence Service to investigated the above mentioned case.
The case was sent for trial to the High Court of Cassation and Justice, proposing to maintain preventive and assurances measures in the said case.
