"Any person can be summoned to testify. And the law provides that if the prosecutor or a court summons somebody in their capacity of witness, he is bound to attend, under the penalty of the law", Răzvan Savaliuc stated.
The journalist pointed out that the reason why Traian Băsescu is not called on to testify in this file is that, in his capacity of witness, he cannot lie. And he would have to answer all the questions which might aggravate things for his brother, or even for himself.
"As the defendant or the accused you can invoke the right to be silent or you can lie. But as a witness, if you do not speak the truth you get under the incidence of perjury. If he were to come as witness, he would have to answer some questions which might worsen things for his brother or even himself, or would focus on him for a future investigation. Everything he says could be used against him ", Răzvan Savaliuc added.
