Out of the six candidates interviewed Wednesday and Thursday at CSM, Laura Codruţa Kovesi proposed as leader of DNA, Bogdan Licu proposed as first deputy prosecutor general, and Codrut Olaru, proposed as Deputy Prosecutor General, have received a positive opinion by unanimous vote from the prosecutors Section of the Council.
Tiberiu Nitu proposed for the position of Prosecutor General of Romania, Alina Bica proposed for DIICOT leadership and Elena Hosu proposed deputy chief prosecutor at DIICOT received a positive opinion by majority vote.
The CSM opinions are advisory and will be sent Friday accompanied by their motivations to the Ministry of Justice. The proposals for the management positions within the Public Ministry, accompanied by these positive opinions will be forwarded to the President of Romania, Traian Basescu, who has got the final saying on these appointments.
According to Law 303/2004, the General Prosecutor of the HCCJ, the First Deputy and the Deputy of the Prosecutor General, the General Prosecutor of the DNA, his deputies, the chief prosecutor of DIOCT and his deputies are appointed by the President on the proposal made by the Minister of Justice, with the SCM opinion, from among the prosecutors who have a minimum of 10 years experience as a judge or prosecutor. They are appointed for a period of three years which can only be renewed once.
The President can refuse the appointments for the management offices with the Public Ministry on reasonable grounds.
All six nominations were made on 3 April by Prime Minister Victor Ponta, who was then Acting Minister of Justice.
The meetings organized by SCM for the hearing of the candidates proposed were attended by CSM President, Oana Schmidt Hăineală, prosecutors George Muscalu, Gabor Bogdan, Elena Hach and Florentina Gavadia as well as by the Justice Minister Robert Cazanciuc, member of the Council.
This was the second demarche to fill in the vacancy with the prosecution offices, the first being initiated by Mona Pivniceru at the time she was Minister of Justice.
