NLP (National Liberal Party) deputy, Tudor Chiuariu, stated that SLU (Social Liberal Union) would address the Constitutional Court the request to enforce the law active at the moment of the referendum initiation, respectively Law 3/2000 in its modified form due to the Government Emergency Ordinance no. 41, which does not include the condition of presence at the ballot boxes of 50% plus one, according to Mediafax press agency.

That version of the Government Emergency Ordinance no. 41 was enacted by the Government one day before the impeachment of President Traian Băsescu, which was actually the start of the procedure to dismiss the chief of state.

Tudor Chiuariu, ex minister of Justice, claims the law effective at the time the procedure to dismiss the President started was Government Emergency Ordinance no. 41/2002, and SLU will request the Constitutional Court to keep to the law. The Ordinance was modified later on by the Parliament and re-enacted on July 24th by interim president Crin Antonescu.

The liberal deputy claims that the procedure to dismiss the President was initiated under the Government Emergency Ordinance no. 41/2002, according to which the chief of state can be dismissed by majority of the votes expressed by citizens that have voted in the referendum, later changes not being applicable.
