According to a bill released for public debate by the Ministry for Internal Affairs, the drivers who drive under the influence, do not cede priority to pedestrians or exceed the statutory speed over 60 km / h will have their licenses suspended for 120 days and will pay the maximum fines from 1,575 to 7,500 lei, Mediafax reports.
The maximum fines under the ordinance, in the Vth category of penalties, from 21 to 100 fine- points (1575-7500 lei), which currently only applies to legal persons, would be applied to drivers who drive with a blood alcohol level below 0.8 g / liter, and to the drivers who do not cede priority to the pedestrian crossing the road according to the regulation or to those who exceed the maximum speed for a given road and for a given category of vehicles by over 60 km per hour ..
Failure to give pedestrians priority is now punishable with a fine from the second category of penalties worth 300 to 375 lei and with suspension of license for 30 days, while driving under the influence of alcohol is sanctioned with a fine from the IVth category of penalties, between 675 and 1,500 lei, and license suspension for 90 days, the same as they sanction for exceeding the maximum speed limit over 50 km / h, the 60 km threshold not being mentioned in the current Highway Code.
The draft amendment to the Highway Code provides new deadlines for suspending the right to drive – ie for a period of 120 days when the offense committed by the driver was prosecuted as a crime, but the application of an administrative penalty was ordered instead, and up to 180 days for a traffic accident that resulted in the death or injury of a person in violation of traffic rules is punishable by suspension of the right to drive even if the offense is not prosecuted as a crime.
The draft bill also provides that the fined drivers who do not pay the penalty amount within 90 days will have their licenses suspended until proof of payment, a provision included in a draft emergency ordinance launched for public debate on February 22 on MAI website.
Even if the sanctioned driver files a complaint with the court, the fine shall not be suspended pending a decision. One can file a complaint against the traffic violation and offense registration report within 15 days since being acknowledged, to the court in whose jurisdiction the offense was committed. The complaint suspends the execution of additional administrative sanctions, such as suspension of the right to drive, the internal affairs press release shows.
Just as the draft Ordinance of February, the current draft bill prohibits the use of vehicles registered in other states and owned by any title by persons who are established, domiciled or resident in Romania for more than 30 days from the date of acquiring the title or from the date of entry of the vehicles and trailers registered in other countries
At the request of the police officer, people driving on public roads a vehicle registered in another state will be required to submit a document proving in what capacity he is allowed to drive the vehicle, accompanied by its certified translation into Romanian, according to the draft.
Failure to comply with these obligations will be punished, if the amendments are adopted, with a fine of the IIIrd category, between 450 and 600 lei, if the driver does not have on him a paper showing his right to drive the vehicle accompanied by its translation, while a IVth category sanction applies, that is between 675 and 1,500 lei for those traveling with a vehicle registered in another state for more than 30 days.
The prohibition to drive in Romania a vehicle registered in another country after the 30 days will not apply to the persons mentioned in the registration certificate, to those who perform public transport or transport goods or persons under a lease or rental, to those who are employees or associates of the persons mentioned in the registration certificate and to those who have entered into a lease agreement, the draft bill also provides.
Those who have not requested the transcript transmission of the vehicle’s ownership within 30 days from the date of acquisition thereof shall be punished by suspending registration, the bill also provides.
Driving a vehicle whose registration was suspended the fines amount provided in the IV category of penalties apply along the additional sanction of suspension of the right to drive for a period of 90 days.
"The draft bill aims to create the necessary prerequisites for the continuous updating of registered vehicles records, facilitating the identification of their users, and the establishment of an additional mechanism to ensure compliance with the offenses enforceability thus substantially reducing the possibility o violate the law," the MAI press release reads.
