Update 14.49 - The Constitutional Court rejected on Wednesday all 12 appeals calling for the cancellation of the first round of presidential elections, complaining about how the poll was conducted at the polling stations abroad, Mediafax reports.

Augustin Zegrean,  president of the Constitutional Court, said Tuesday that the law provides that  only those who have run or the  parties that proposed  the candidates can file such complaints but  the court will consider  all complaints filed  to the Constitutional Court, most of them being "transmitted online ".

  

Asked if a possible election fraud might be proved that could lead to a decision to cancel the elections of November 2, Augustin Zegrean said that the trial judge should not administer evidence but  the one who  delivered  the indictment   must come up with evidence.  

Under the law, application for annulment of elections can be made by political parties, political alliances, electoral alliances, organizations of citizens belonging to national minorities represented in the Council of National Minorities and the candidates who participated in the election, no later than three days since the  closing  of the voting. The request must be filed together with the evidence on which it relies.

 

 

The Constitutional Court cancels the  elections if the  voting and  the results determination occurred by fraud likely to  alter the order  of the candidates tenure awarding who can participate in the second round. In this case, the Court will have to repeat  elections on the second Sunday of the date of cancellation of elections.

 

 

Appeals must be resolved by Friday, November 7, when, according to the electoral calendar, the results of the first round must be reported and validated by CC.

 

 

Victor Ponta the UNPR PSD-PC alliance candidate, won 40.44% of votes in the first round of the presidential elections, followed by Klaus Johannis (ACL), for whom 30.37% of voters voted, and Tariceanu - 5.36%, according to provisional final results announced Tuesday by the Central Electoral Bureau

CCR gives a verdict today in the case of the 12 complaints filed for the cancellation of the first round of presidential elections. One of these was made by  candidate Gheorghe Funar who failed to pass in the second round.

The Constitutional Court is the forum to validate the first round after the operations  completion by  BEC.
It is only then that the second round can be initiated. Most likely Friday will be the day that CCR will decide whether or not to  validate the Nov. 2 elections.
