Deputy General Prosecutor of Romania, Daniel Morar, believes that the President cannot be held liable for the offense during his term in the office other than for high treason.
Morar’s point of view appears in the resolution dismissing a complaint filed by attorney Dan Chitic after President Traian Basescu received a NUP (not to initiate prosecution – r.n ) in a case filed by the lawyer above.
"Regarding the criminal liability of the President of Romania, according to the constitutional provisions during his term in the office, he can be investigated only if he would commit the crime of high treason", Daniel Miller, Deputy Prosecutor General of Romania explains in resolution.
In the same document, Morar explains why the president should enjoy protection under the law.
“The immunity is justified by considerations of political expediency, the president representing an institution with the highest authority in the state, it is necessary to maintain that authority therefore it is necessary that the person representing it should not be harmed ", Daniel Morar says.
Lawyer Dan Chitic accused the president in August 2010, that he allegedly slapped him and had called him animal in a restaurant parking in Ciresica Neptune. The incident would have been caused by several critical comments made by the lawyer to Traian Basescu. The Head of State was involved in yet another scandal in 2004, when he allegedly slapped a child over the face.
